Description: Technology and the use of electronic equipment on ships has advanced rapidly over recent years. It has changed the way data and information is presented, stored, recorded and retrieved, during routine operations and following a maritime incident. An essential companion to Guidelines for Collecting Maritime Evidence, Volume 1, this second volume focuses on electronic evidence—an important dimension in the collection and presentation process that will be of interest to a range of parties, not least the ship‘s Master, crew and management ashore.
Electronic evidence includes data and information collected from the many systems and equipment onboard ship that log their operation and output. It also includes photographic, video and audio evidence collected from mobile devices in the digital age. Data from ECDIS, VDR and AIS are vital resources for the investigator. Accordingly, the threats and opportunities of artificial intelligence and digital reconstruction are examined while the ethics of evidence collection is also addressed.
The new edition has been expanded to include updates on subjects such as machinery failure, fire damage and cargo deterioration. Contributors drawn from a wide range of disciplines discuss the roles of the average adjuster and the mariner lawyer, cover evidence collection from the P&I perspective and that of the naval architect, and consider subjects as diverse as fire, deterioration of agricultural cargoes, machinery failure and surveying. A chapter is devoted to the evolving landscape of evidence collection, including the impact of artificial intelligence. Volume 2 also goes into more detail about the recovery and preservation of electronic evidence and the way it can be used to create a visual reconstruction of an incident.
This book will be as relevant to mariners as it will be to ship managers, insurers, average adjusters and legal professionals. It provides vital guidance on how to respond after an incident, when many investigating bodies are likely to be competing for the Master’s attention. Acknowledged experts in their various fields explain in clear language the evidence needed, how it should be preserved and how it will be used. As Marius Schonberg of Gard AS notes in the Foreword, evidence collection is not just about defending a claim—it is about improving how we operate, moving beyond assumptions to understand real causes and providing a credible basis for change.
